A- USE OF WEBSITE SUBJECT TO TERMS AND CONDITIONS
Your access to, and use of this website and your purchase and use of the services and products able to be purchased via the website is subject to the following terms and conditions. By using the website you represent that you have read, understood and accepted these terms and conditions, and agree to be bound by them.
B - REGISTRATION AND ORDERS
1. REGISTRATION TO COOKING CLASSES
You may register to cooking classes on the website or via email to Estellegourmet, according to class availability.
The agreement is final upon payment of a $100 deposit and confirmation of the date between both parties..
2. ORDERS OF PRODUCTS
Your orders of products may be placed on the website or via email to Estellegourmet.
The agreement is final when Estellegourmet sends you an email of confirmation.
Unless otherwise agreed, you may not purchase Estellegourmet products for the purpose of resale.
3. PRIVATE PARTY SERVICES
You may select the products and services for your private party on the website or via email to Estellegourmet.
Estellegourmet will provide you with a quotation.
You agree on the price and conditions by accepting the quotation via email.
Unless otherwise agreed, you may not purchase Estellegourmet products for the purpose of resale.
C- PRICE AND PAYMENT
Prices listed on the website do not include taxes. All amounts are in US dollars.
Payments must be made in cash, credit card or by check payable to: Estelle Gourmet - 1971 Palmer Avenue, Larchmont NY 10538.
Estellegourmet will send you an invoice via email upon request.
1. COOKING CLASSES
Reservation is final upon payment of a non refundable deposit.
All classes must be paid in full 1 week before day when the class is scheduled.
2. ORDERS AND PRIVATE PARTIES
For orders and services exceeding $100, a non-refundable deposit of 50% of the total price must be paid by check, credit card or cash minimum one week in advance. This deposit is deductible from the total due amount. The balance shall be paid at delivery or pickup.
For special events with numerous orders (the Holiday season for example), customers may be asked for full payment upfront, to facilitate the pick up process at the boutique.
D- DELIVERY AND PICKUP
When you place your order, you may ask for a delivery, for a minimum order of $500, for catering orders.
The delivery area includes Scarsdale and the Zip codes within 5 miles from Estellegourmet's facility. The delivery fee is $50.
For Further delivery distance please contact Estellegourmet.
You may also choose to pickup your order at our facility, conveniently located in Larchmont. There is no charge for pickup.
Estellegourmet shall be entitled to assume that any person accepting delivery of the products is either the customer or someone that is authorized to do so on behalf of the customer.
Estellegourmet aims to deliver on time but may from time to time be delayed and shall not be liable for failure to deliver on a timely basis.
Despite all our efforts to ensure perfect service, if any product delivered does not correspond to a product ordered, you can:
a- keep the incorrectly-delivered product , in which case no adjustment will be made to the payment due from you for the order containing the incorrect product; or
b- reject the incorrectly-delivered product, in which case Estellegourmet will refund the value of the product that was originally ordered.
E- OWNERSHIP AND RISK
Ownership, responsibility and risk in the products shall pass to the Customer on delivery or pickup.
F- WARRANTIES
All representations, terms, warranties, guarantees, or conditions whether implied by statute, common law or otherwise, including, but not limited to, implied warranties, guarantees or conditions of merchantability and/or fitness for a particular purpose, tolerance to any conditions or similarity to sample are excluded to the fullest extent permitted by law. You must ensure that the products are not used for any purpose for which they are not suitable and you are responsible for using all necessary skill and care in handling and using the products. You expressly acknowledge and agree that Estellegourmet does not assume any obligation or liability for any advice given, and that all such products are accepted by you entirely at your risk.
G - LIABILITY AND INDEMNITY
1. ALLERGIES AND SPECIFIC DIETARY REQUIREMENTS
The products are not designed to cater for allergies or specific or cultural dietary requirements. You must take care and have all responsibility for checking the ingredients in the products.
Estellegourmet's kitchen uses eggs, fish, milk, shellfish, soy, peanuts, tree nuts and wheat ingredients.
2. PRODUCT LIABILITY
The liability of Estellegourmet whether in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from any defect in, or non-compliance of, a product or service or any other breach of Estellegourmet's obligations here-under shall not in any event exceed an amount equivalent to the price of the relevant product or service.
3. NO LIABILITY FOR INDIRECT LOSS
Estelllegourmet shall not be liable for any consequential, indirect or special damage or loss of any kind whatsoever arising from or in relation to your use of, or inability to use, the website, or the delivery or failure to deliver any products or services.
H - INTELLECTUAL PROPERTY
All right, title, logo, Trademark and interest in all Intellectual Property in all concepts, systems, written, graphic and other material relating to the website and its contents and all recipes is owned by, and shall at all times remain the exclusive property of Estellegourmet.
I - FORCE MAJEURE
If the performance by Estellegourmet of its obligations under these terms and conditions is prevented by reason of "force majeure" (which shall include prevention occasioned by fire, casualty, accident, act of God, natural disaster, any law, order, shortage or unavailability of products or raw materials, delay in transit, electricity or communications failures, extreme weather conditions, or other causes whatsoever beyond the reasonable control of Estellegourmet) Estellegourmet shall be excused from such performance to the extent of such prevention.
J - PRIVACY
1. COLLECTION OF INFORMATION
The Website contains applications which collect personal information about you. Estellegourmet will only use this information to the extent authorized by you, and will only disclose it in the manner set out below.

If this notice is not respected, you will be liable for the payment of the total price of the order, service or the cooking class.
L - GIFT VOUCHERS
1. BUYING GIFT CERTIFICATES ONLINE
Gift certificates may be purchased online from anywhere in the world, but Estellegourmet can only deliver products and services in the area described in article D.
Estellegourmet will deliver gift certificates purchased by you via email to your email address.
You are responsible for ensuring that all information provided in relation to purchase is correct.
2. REDEEM OF THE GIFT CERTIFICATE
The gift voucher can be redeemed on the Website or by email to Estellegourmet.
A gift voucher for a cooking class shall be redeemed by registering to a cooking class in the terms and conditions mentioned on the voucher. A gift certificate for an order of products shall be redeemed by placing an order of the amount indicated on the voucher.
Please allow a minimum of two weeks’ notice for a mutual date to be agreed on.
3. GIFT CERTIFICATE TERMS & CONDITIONS
All gift vouchers expire 12 months from date of purchase.
Gift certificates will not be refunded or replaced.
Gift certificates value cannot be redeemed for cash or credited to a bank account.
All purchases of products using a gift voucher will otherwise be subject to these terms and conditions.
